Terms of Use for Friends Loyalty Program

Effective date: May 26th 2026

1. Scope

1.1 These terms and conditions (the “Terms”) apply to the Friends Loyalty Program (the “Maxi Zoo Friends Loyalty Program” or “Loyalty Program”). The Maxi Zoo Friends Loyalty Program is offered by Fressnapf Tiernahrungs GmbH, with its registered office at Westpreussenstrasse 32-38, 47809 Krefeld, Germany, registered in the commercial register of the Krefeld District Court under number HRB 5030 (“we”, “our” or “Maxi Zoo”).

1.2 The Friends Loyalty Program is offered free of charge to our customers, but certain conditions must be met, including logging in or creating a Maxi Zoo customer account and activating the Loyalty Program. These Terms apply to the Loyalty Program including receiving, holding and redeeming loyalty benefits.

1.3 Members of the Loyalty Program can enjoy exclusive benefits. The type and nature of the benefit (e.g., special discounts, special prices, donation campaigns, or special events), as well as the timing and duration of the offer to receive the benefit, will be specified on the website https://www.maxizoo.ie/friends, the Maxi Zoo app, and/or in flyers in stores.

1.4 Any price reductions shall under no circumstances give rise to any refund or be applied retroactively.

1.5 Discounts offered as part of the Loyalty Program apply only to a quantity of items ordered that is compatible with the size of the household and for personal consumption.

2. Eligibility to participate

2.1 Only Maxi Zoo customers who are consumers, i.e., natural persons acting mainly for purposes that do not fall within the scope of their commercial activity, trade, business or profession, may participate in the Maxi Zoo Friends Loyalty Program. The Friends Loyalty Program is not available to businesses and does not apply to purchases made for professional purposes.

2.2 To be eligible for the Maxi Zoo Friends Loyalty Program, you must be at least 18 years old [and reside in Ireland].

2.3 You must have a Maxi Zoo customer account in order to participate in the Loyalty Program. The loyalty benefits granted under the Loyalty Program are personal and non-transferable to another party.

3. Conditions of participation

3.1 To benefit from the Friends Loyalty Program when shopping in our brick-and-mortar stores or on our online store (www.maxizoo.ie), you must have a Maxi Zoo customer account. Registration for a Maxi Zoo customer account requires the provision of certain personal data, including a valid e-mail address. For more information on how we use your personal data in connection with the Friends Loyalty Program, please see the  Privacy Policy.

4. Registration for the Maxi Zoo Friends Loyalty Program

4.1. Registration for the Friends Loyalty Program – General provisions

You must register for the Loyalty Program in order to receive and avail of all of the benefits of it. If you do not register for the Loyalty Program, you will not be eligible to receive, hold or redeem benefits under it. Once you have created a Maxi Zoo customer account and/or logged in to it, you can register for the Loyalty Program. Please note that participation in the Friends Loyalty Program is voluntary, and it is not a condition for purchasing goods from us. Registration for the Friends Loyalty Program requires you to accept these Terms and to provide us with certain personal data, including your e-mail address, first and last name, and to create at least one pet profile. 4.2 Registering for the Friends Loyalty Program with the Maxi Zoo app

To register for the Loyalty Program with the app, you must log in to your Maxi Zoo customer account and register for the Loyalty Program via the Maxi Zoo mobile app, which can be downloaded free of charge from the iOS App Store, Google Play Store and Huawei App Gallery. If you register for the Loyalty Program with the app, your personal QR code for the Maxi Zoo Friends Loyalty Program will be available on the Maxi Zoo app.

4.3 Activating the Friends Loyalty Program on the website

You can also register for the Loyalty Program online through our website at: www.maxizoo.ie/friends via your Maxi Zoo customer account without first downloading the app.

5. Availing of the benefits of the Loyalty Program

5.1 In order to enjoy your loyalty benefits in our brick-and-mortar stores, the Maxi Zoo Friends Loyalty Program must first be registered, as set out above via the app or the website, and the QR code generated in the Maxi Zoo mobile app must be presented and scanned at the checkout.

5.2 When making a purchase on our online store, the benefits associated with your Loyalty Program will be applied automatically at the end of the purchase process, provided that you are logged into our Maxi Zoo online store with the Maxi Zoo customer account you used to register for your Loyalty Program in the app or via the website.

5.3 Your personal QR code available via the app may not be passed on to or used by third parties under any circumstances. In the event of misuse of the Loyalty Program (e.g., passing on the QR code to a third party, excessive use of the Loyalty Program, or violation of this section), Maxi Zoo reserves the right to prohibit the beneficiary from using it.

6. Loyalty Program benefits cannot be combined with other discounts

The benefits of the Maxi Zoo Friends Loyalty Program cannot be combined with other discounts (e.g., promotional codes included in our newsletters, promotional coupons in the Maxi Zoo app or in our brick-and-mortar stores, etc.) unless it is expressly stated that these discounts can be combined with the benefits of the Loyalty Program. If different discounts are applicable to the same products, we will automatically grant you the discount that is most advantageous to you financially.

7. Changes to the Maxi Zoo Friends Loyalty Program

We reserve the right to amend, alter, modify, or supplement these Terms with future effect. Any changes we make will be for a valid reason, such as changes in applicable law, improvements to our services, changes in market conditions, or updates to our technology and systems. Typically permitted changes include adjustments to the operation of the Loyalty Program, updates to eligibility criteria, modifications to benefits or rewards, or changes to account management procedures. In the event of any changes to these Terms, we will notify you of such changes with four (4) weeks’ notice, unless the changes are required by applicable law. If you do not agree with the proposed changes, you have the right to terminate your membership in the Loyalty Program before the changes take effect.

The Loyalty Program is valid for an indefinite period, but particular benefits may be subject to specific periods of availability, as described in the terms describing the benefit. If the Loyalty Program is discontinued, the benefits associated with the Loyalty Program will expire.

8. De-activating  or terminating your participation in the Maxi Zoo Friends Loyalty Program

You may terminate your membership of the Loyalty Program at any time for any reason by logging in to your Maxi Zoo customer account and clicking on the unsubscribe option in your Friends benefit world or by contacting our customer service department via the contact form https://www.maxizoo.ie/help/contact/other/. If you close your Maxi Zoo customer account or terminate your membership in the Loyalty Program, your benefits will expire.

In the case of fraud, providing incomplete or false information, where you do not adhere to Terms as amended from time to time, where you use Loyalty Program membership rights other than in accordance with these Terms, or you act illegally we are entitled to immediately terminate your membership of the Loyalty Program. We will inform you if we take such action.

9. Liability

9.1 Nothing in these Terms excludes or limits our liability in the event of:

·         death or personal injury caused by our negligence;

·         fraud or fraudulent misrepresentation; or

·         any other liability which cannot be excluded or limited under applicable law.

9.2 If we fail to meet any of our obligations, we will be liable for any foreseeable loss or damage you suffer that is a foreseeable result of our breach of the terms and conditions or our negligence. However, we shall not be liable for any unforeseeable loss or damage, except to the extent required by applicable laws. A loss or damage is considered foreseeable if it is an obvious consequence of a breach of contract or if it was contemplated by the parties when accepting the terms and conditions.

9.3 Nothing in these Terms affects your statutory rights under applicable law.

10. Contract language and governing applicable law

The language of the contract is English. The applicable law is [Irish] law. This choice of applicable law does not prejudice the application of your statutory rights, in particular in matters of consumer law, of the country in which you have your habitual residence.

In the event of difficulties with an online purchase, we ask that you first contact our customer service department. We are not obliged to participate in ADR procedures [but we are willing to engage in these procedures with the approved ADR body [and we do not engage in ADR procedures.

These terms are governed by Irish law and wherever you live you can bring claims against us in the Irish courts, or in the country you live in. We can claim against you in the courts of the country you live in, as you indicated when you opened the account.
